Penalties for Non-Compliance Under the Motor Vehicles Act
Operating a commercial vehicle without valid documents is not just a paperwork issue – it has serious legal and financial consequences. Fines under the amended Motor Vehicles Act (2019) are significantly higher than earlier levels.
No Permit or Expired Permit
Fine up to Rs. 10,000 for first offence. Vehicle may be seized. Permit must be renewed before release.
Expired Fitness Certificate
Fine up to Rs. 5,000. Vehicle treated as unfit for road use. Insurance claims may be rejected during lapsed period.
No PUC Certificate
Fine up to Rs. 10,000 for first offence under 2019 amendments – a significant increase from earlier Rs. 1,000.
Overloading
Rs. 20,000 plus Rs. 2,000 per additional tonne. Permit may be suspended for repeat offences.
No PSV Badge (Passenger Vehicles)
Driver fined separately from the vehicle owner. Badge-less driving is a distinct offence from license violations.
Impound and Storage Charges
Yard storage fees of Rs. 100 to Rs. 500 per day depending on vehicle category – costs accumulate fast.

Types of Vehicle Permits in India – Explained
National Permit
A National Permit authorizes goods vehicles to operate across all states in India. It is issued by the home state RTO and requires a separate annual authorization fee to be paid in each state the vehicle enters. A common misconception is that one national permit payment covers all states – it does not. Each state endorsement must be current. National permits are issued for 1-year or 5-year periods.
State Permit
A State Permit restricts the vehicle to operating within a single state. It is significantly cheaper than a National Permit but limits your operational geography. State permits are appropriate for local distributors, intra-city logistics operators, and regional transport companies who do not cross state borders regularly.
All India Tourist Permit (AITP)
For tempo travellers, luxury coaches, and tourist vehicles operating across state borders, the All India Tourist Permit is the correct authorization. It is different from a standard contract carriage permit and requires the operator to hold a tourist vehicle operator license. Operating tourist routes on an ordinary permit is a common – and heavily penalized – violation.
Contract Carriage Permit
This permit covers vehicles hired under a specific contract for a journey – including app-based cab aggregators, private buses, and employee transport operators. The permit does not allow picking up passengers on route like a stage carriage. Operators must carry a copy of the contract in the vehicle at all times.
Stage Carriage Permit
Issued for public buses and shared transport services that operate on a fixed route with designated stops. Government transport corporations typically hold bulk stage carriage permits. Private operators entering bus services must apply with route proposals to the State Transport Authority for consideration.
