Understanding the RTO NOC

A No Objection Certificate (NOC) issued by the RTO is a legal requirement under Section 48 of the Motor Vehicles Act, 1988. It serves as a formal clearance stating that the registered vehicle has no pending dues, traffic fines, or criminal liabilities in its current jurisdiction. Whether you are relocating permanently or selling your vehicle to an individual in a different state, the NOC is the foundational document for re-registration.

The process involves coordinating between the Source RTO (where the vehicle is currently registered) and the Destination RTO (where the vehicle will be moved). Since vehicle records are now centralized via the Parivahan Sewa portal, obtaining an NOC requires a digital application backed by physical verification of engine and chassis imprints.

Types of NOC Services

Inter-State Transfer

Required when moving a vehicle from one State/UT to another (e.g., Maharashtra to Delhi). This NOC is mandatory for obtaining a new RC and paying the pro-rata road tax in the new state.

Intra-State Transfer

Necessary when moving between different RTO jurisdictions within the same state (e.g., Pune to Mumbai). This ensures the local records are updated for address changes.

Ownership Transfer NOC

When selling a vehicle to a buyer outside the current RTO jurisdiction, this certificate clears the seller of future liabilities and enables the buyer to initiate RC Transfer.

NOC Cancellation

If you obtained an NOC but decided not to move or sell the vehicle, a formal Non-Utilization Certificate (NUC) must be obtained to “cancel” the move and restore the RC status.

Rules & Eligibility Standards

Obtaining an NOC is subject to the compliance of the following regulatory benchmarks set by MoRTH:

Compliance Metric	Official Requirement
Vehicle Age Limit	NOC is not issued for Diesel vehicles >10 years or Petrol >15 years in restricted zones (like Delhi NCR) unless moving to permitted zones.
Hypothecation Status	If the vehicle has an active loan, an NOC from the bank (Form 35) is mandatory before the RTO processes the request.
Tax Liabilities	All Road Taxes and pending ‘Challans’ must be cleared at the source RTO before application.
Blacklist Check	The vehicle must not be ‘Blacklisted’ by any investigative agency or the RTO due to document discrepancies.
Validity	Typically, an RTO NOC is valid for 6 months. Registration in the new state must be initiated within this window.
