Duplicate Driving License

A Driving License is the document that authorizes a person to drive a specific category of motor vehicle on public roads under the Motor Vehicles Act, 1988. It is what a traffic officer checks during a routine enforcement stop, what a car rental company demands before handing over keys, what a logistics employer asks for before onboarding a driver, and what many government schemes accept as a valid identity document. When this card is lost, stolen, mutilated, or fades beyond legibility, the person’s legal right to drive does not expire – but their ability to prove it does, which creates the same practical problem as not having a licence at all.

In India, a duplicate driving license is issued under Rule 13(1) of the Central Motor Vehicle Rules, 1989. In many licensing authorities that have completed the Sarathi migration, the duplicate Smart Card DL is printed centrally and dispatched to the registered address by speed post, reducing in-person visits to a single appointment for biometric capture. However, the degree of Sarathi migration varies across states and licensing offices – some still process duplicate applications partly or entirely through physical counter submission, and the applicant needs to know their specific office’s current process before arriving.

There are several distinct scenarios under which a duplicate DL application is filed, and each carries a different combination of supporting documents. Where the licence is lost or stolen, an FIR or Non-Cognizable Report from the police is required, clearly mentioning the DL number. Where the licence card is physically damaged, mutilated, torn, or faded to the point of illegibility, the original card is surrendered to the licensing authority with Form LLD – no FIR is needed since the original document is in hand. Where the licence had already lapsed for more than six months at the time it was lost, the case falls into a category requiring additional permission from the Transport Department headquarters or state-level authority before the duplicate-cum-renewal can be processed – this is not a standard Form LLD case and takes longer.

For commercial driving licence holders – drivers of taxis, auto-rickshaws, buses, and goods vehicles – the duplicate DL process carries additional requirements. A challan clearance report from the traffic enforcement authority is required in many states before the duplicate is processed, and the applicant’s record is cross-checked to ensure the commercial DL was not previously issued from a different licensing authority. This verification layer exists because commercial licences carry a higher level of public safety responsibility and the consequences of fraudulently duplicating one are more serious than for a private vehicle licence.

For applicants who have moved to a different state or city since their DL was issued, a common and entirely avoidable problem arises: they approach the RTO in their current city, are told the case must go to the original issuing authority, and then face the practical challenge of coordinating a process in a city they no longer live in. This situation is further complicated where the original licensing authority is in a district with limited Sarathi portal functionality, making remote application difficult. The Form LLD application in such cases has to be submitted either through a local representative or through a documented agent at the original licensing authority’s office.

The DigiLocker app and the mParivahan app carry a digitally signed version of the DL that is recognized as a valid document under the Information Technology Act, 2000, and Ministry of Road Transport and Highways circular. While the physical Smart Card duplicate is in process, carrying this digital version on your phone reduces the risk of enforcement complications during the waiting period. However, the digital DL does not substitute for the physical Smart Card in all contexts – car rental companies, bank KYC processes, and many employment verifications still require the physical card. Getting the duplicate issued remains necessary even if the digital version provides temporary day-to-day cover.

For applicants whose licence number is not known – because they never kept a photocopy, their only copy was in the lost wallet, and they never digitally scanned it – the DL details can often be retrieved through the Sarathi Parivahan portal using the licence holder’s name, date of birth, and state of issue. The DL number is essential for the FIR as well as for Form LLD, so this retrieval step has to happen before any other part of the process begins. In cases where Sarathi retrieval also fails, the original issuing licensing authority’s records can be manually accessed with identity proof.

When You Need a Duplicate Driving License

Lost or Stolen Licence: File an FIR or NCR at the nearest police station, ensuring the licence number and the circumstances of loss are clearly recorded. The FIR copy accompanies Form LLD and the physical fitness self-declaration in Form 1 when submitted to the original issuing licensing authority.

Mutilated, Torn, Faded, or Damaged Licence: Surrender the original damaged card along with Form LLD. The licensing authority verifies the surrendered card against its own record before issuing the replacement Smart Card. No FIR is required where the original card is being physically handed over.

Licence Expired Beyond Six Months at Time of Loss: If the licence had already lapsed for more than six months before it was lost or destroyed, the case requires specific permission from the state Transport Department authority before the duplicate-cum-renewal can be processed. This is handled separately from a standard Form LLD application and takes additional time.

Commercial Licence Duplicate: Commercial DL holders must additionally provide a challan clearance report in states where this is required, and the record is cross-checked across licensing authority databases before approval. Private and commercial cases should not be treated as procedurally identical.

Address Update Alongside the Duplicate

Where the address on the original DL record differs from the licence holder’s current address, the correction can be requested alongside the Form LLD application, provided current address proof is submitted at the same time. Rules and Eligibility

A duplicate driving license application is governed by Rule 13(1) of the Central Motor Vehicle Rules, 1989 and processed by the licensing authority that originally issued the licence. The following conditions determine eligibility, processing pathway, and outcome.

  • Original Issuing Authority Rule: Form LLD must be submitted to the same licensing authority that issued the original DL. That office holds the applicant’s records and is the only one authorized to verify particulars and issue the duplicate. Submitting to any other licensing authority results in the application being returned.
  • Licence Holder’s Duty to Intimate: Rule 13(1) requires the licence holder to forthwith intimate the loss or destruction of the licence to the issuing authority and apply for a duplicate. Continuing to drive without valid physical proof while delaying this intimation is a violation of the Motor Vehicles Act.
  • No Fresh Driving Test Required: A duplicate DL application does not require a fresh driving test, since the duplicate carries forward the same vehicle categories and validity as the original licence. Competence was already established at the time of the original licence grant.
  • Validity Carry-Forward: The duplicate DL carries the same validity period as the original licence it replaces. It does not reset or extend the expiry date. A licence expiring in three years will have a duplicate that also expires in three years from the original issue date.
  • Lapsed Beyond Six Months: Where the DL had already expired for more than six months at the time it was lost or damaged, the case is not processed as a standard duplicate. It requires specific permission from the state Transport Department authority before a duplicate-cum-renewal is issued, and may involve additional scrutiny. This is distinct from a licence that was valid at the time of loss but has since lapsed while the duplicate application was pending.

  • Digital DL as Interim Proof: The DL available through DigiLocker or the mParivahan app is recognized as a valid document under the Information Technology Act, 2000, and Ministry of Road Transport and Highways notifications, and can be used during enforcement checks while the physical Smart Card duplicate is being processed. This does not substitute the physical card for non-enforcement purposes such as bank KYC, car rentals, or employment verification.
  • Penalty for Non-Intimation: Driving without carrying a valid physical licence – or without having intimated the loss as required under Rule 13(1) – can attract a penalty under the Motor Vehicles Act during a routine enforcement check. Carrying the FIR copy and application acknowledgment while the duplicate is in process helps avoid disputes with traffic enforcement authorities.
  • Out-of-State Applicants: A licence holder who has moved to a different state is still required to apply for the duplicate at the original issuing licensing authority. There is no provision to transfer the duplicate application to a licensing authority in the current state of residence. Re-licensing in the new state is a separate process from the duplicate application.
