Welcome to Kagzikaam. By accessing our platform or utilizing our services, you agree to be bound by these Terms & Conditions. Please read them carefully. If you do not agree, you must discontinue use of this platform immediately. These terms are governed by the laws of India.

1. Nature of Service

• Kagzikaam provides facilitation, documentation assistance, and agent coordination only.
• We do not act as, nor represent, any government authority or RTO department.
• Processing timelines and final approvals are exclusively controlled by the respective RTO officials and government systems.
• Kagzikaam connects users with verified local RTO consultants and agents. The quality of service delivered by these agents is subject to our partner compliance standards (see Section 7).

2. No Guarantees

• We do not guarantee specific outcomes, approval of applications, or fixed delivery dates, as these depend entirely on government workflows and RTO workload.
• Information provided on this platform is based on current RTO guidelines and professional experience. Rules may change without notice – always verify with the relevant RTO before proceeding.
• Estimated timelines shared at the time of service initiation are indicative only and not contractually binding.

3. User Responsibility & Prohibited Uses

• Users must ensure all information and documents submitted are 100% accurate, genuine, and legally valid.
• Kagzikaam is not liable for rejections, delays, or legal penalties resulting from forged, incomplete, or incorrect data submitted by the user.
• If Kagzikaam or its agents discover fraudulent documents during the process, the service will be suspended immediately and the matter may be reported to the appropriate authorities.

You may not use this platform to:

• Submit false or misleading information or impersonate another person.
• Attempt to bribe, influence, or contact RTO officials through our platform or agents.
• Scrape, copy, or reproduce platform content without written permission.
• Use the platform for any purpose that is unlawful under Indian law.

4. Payments & Fee Structure

• Service Fees: Charged by Kagzikaam for consultation, document preparation, agent coordination, and status tracking. These fees will be communicated to you clearly before payment is collected.
• Government Fees: Separate official charges payable directly to the Transport Department as per their current schedule. These are not collected by Kagzikaam and are subject to change by the government at any time.
• Fee estimates provided before service commencement are indicative. If government fee structures change after your payment, Kagzikaam will inform you of the revised amount before proceeding.
• Payments made through this platform are processed via third-party payment gateways. Kagzikaam does not store your card or banking details.

5. Limitation of Liability

Kagzikaam shall not be held responsible for:

• Delays caused by RTO backlogs, staff unavailability, or government system failures.
• Sudden changes in government policy, document requirements, or fee structures.
• Technical downtime of Parivahan, DigiLocker, or any other government portal.
• Actions or omissions of third-party agents beyond what is covered by our partner compliance standards.
• Any loss, direct or indirect, arising from reliance on information provided on this platform that has since been superseded by updated government rules.

In no event shall Kagzikaam’s aggregate liability exceed the service fee paid by the user for the specific service in question.

6. Refund & Cancellation

• Service fees are non-refundable once documentation work has commenced. “Commencement” is defined as the point at which your documents have been reviewed and submitted to an agent or to the RTO portal.
• If a service has not yet commenced, a cancellation request submitted within 24 hours of payment may be eligible for a refund – subject to review. Please see our Refund Policy for full details.
• Statutory government fees, once paid to the Transport Department, cannot be refunded under any circumstances as they are governed by government rules outside Kagzikaam’s control.

7. Service Provider Compliance

• All agents and partners onboarded via Kagzikaam must operate within legal and ethical boundaries as defined in our Partner Agreement.
• Providers are strictly prohibited from misrepresenting themselves as government employees or RTO officials.
• Kagzikaam reserves the right to remove any agent from the platform who violates these standards. Users who experience agent misconduct should report it immediately to support@kagzikaam.com.
• Kagzikaam’s liability for agent actions is limited to facilitating a resolution or replacement of the agent. Financial liability for agent fraud is covered only where Kagzikaam has been directly at fault in the onboarding or oversight of that agent.

8. Data Collection & Privacy

• By using this platform, you consent to Kagzikaam collecting and processing your personal data (name, phone number, vehicle registration details, and uploaded documents) for the purpose of delivering the requested service.
• Your data may be shared with verified partner agents solely for the purpose of processing your RTO application. It will not be sold to third parties.
• Kagzikaam complies with applicable Indian data protection laws including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.

9. Intellectual Property

• All content on this platform – including text, design, logos, graphics, and service descriptions – is the intellectual property of Kagzikaam and is protected under applicable copyright and trademark law.
• You may not reproduce, distribute, or create derivative works from any platform content without prior written consent from Kagzikaam.

10. Third-Party Links & Portals

• This platform may reference or link to external government portals such as Parivahan.gov.in, DigiLocker, and others. These are operated by independent government bodies.
• Kagzikaam has no control over the content, availability, or policies of these external sites and accepts no responsibility for them.

11. Changes to These Terms

• Kagzikaam reserves the right to update or modify these Terms & Conditions at any time without prior notice.
• The “Last Updated” date at the top of this page reflects the most recent revision. Continued use of the platform after any changes constitutes your acceptance of the revised terms.
• For material changes, we will make reasonable efforts to notify active users via email or a notice on the platform.

12. Eligibility

• You must be at least 18 years of age to use this platform and enter into a binding service agreement.
• By using this platform, you represent that you have the legal capacity to enter into these terms under Indian law.
• If you are using this platform on behalf of another person or entity, you represent that you are authorized to do so.

13. Indemnification

You agree to indemnify and hold harmless Kagzikaam, its employees, agents, and partners from and against any claims, losses, liabilities, damages, or expenses (including legal fees) arising out of:

• Your violation of these Terms & Conditions.
• Your submission of false, forged, or misleading documents or information.
• Your violation of any applicable law or third-party rights in connection with your use of this platform.

14. Governing Law & Dispute Resolution

• These Terms & Conditions are governed by and construed in accordance with the laws of India.
• Any dispute arising out of or in connection with these terms shall first be attempted to be resolved through mutual discussion and good-faith negotiation within 30 days of the dispute being raised.
• If unresolved, disputes shall be subject to binding arbitration under the Arbitration and Conciliation Act, 1996, with proceedings conducted in English in Delhi, India.
• The courts of Delhi, India shall have exclusive jurisdiction for any matters not subject to arbitration.
